Summary
These are the terms under which you may use the Free version of the Fashionably Late Chrome extension. Fashionably Late is provided free of charge, as-is, and without warranty. By installing or using the extension, you agree to these terms. If you do not agree, do not install or use the extension.
This document is intentionally short. If a section seems unusually plain-spoken, that is deliberate.
1. The provider

References to “we,” “us,” and “our” mean Fenil Dedhia in that capacity. References to “you” and “your” mean the individual or entity using the extension.
2. What you’re agreeing to
By installing or using the Free version of Fashionably Late, you agree:
- These terms apply to your use of the extension.
- You will use the extension lawfully and in accordance with the terms and Gmail’s own terms of service.
- You understand that the extension is provided for free and is not a paid service. No support service-level agreement, uptime guarantee, or paid-service obligation applies.
3. What you get
The Free version of Fashionably Late provides:
- Enhancements to Gmail’s native Schedule Send feature, including timezone-aware scheduling suggestions and the ability to manage settings, pinned timezones, and a local recipient-timezone cache.
- All features available in the version of the extension you have installed at any given time.
We may add, change, or remove features in future versions of the extension. Changes will be made available through the Chrome Web Store update mechanism, and you can choose to update or not.
4. License to use the extension
We grant you a non-exclusive license to install and use the Free version of the Fashionably Late extension for your own personal or internal business use, subject to these terms.
The extension’s source code is published in a public repository on GitHub under the Apache License, Version 2.0. The license text is available at https://www.apache.org/licenses/LICENSE-2.0 and in the repository’s LICENSE file. Use of the source code (including copying, modification, distribution, and creation of derivative works) is governed by the terms of that license rather than by this Section 4.
5. What you may not do
You may not:
- Reverse-engineer, decompile, or attempt to derive the source code from the compiled extension, except to the extent expressly permitted by applicable law.
- Use the extension in a way that violates any law, including the laws applicable in your jurisdiction.
- Use the extension to harass, harm, or violate the rights of others, including by scheduling unsolicited or unlawful bulk email.
- Use the extension in a way that violates Gmail’s terms of service or Google’s terms of service.
- Repackage, redistribute, or sell the extension, in whole or in part, without prior written permission.
- Attempt to circumvent or interfere with the extension’s intended behavior, including its privacy commitments described in the Privacy Policy.
6. Your data
The Free version of Fashionably Late does not collect, transmit, or store your data on any server. All data the extension handles lives on your device. Full details are in the Privacy Policy at https://fashionablylate.app/legal/privacy.
You retain full control of and full responsibility for the data the extension stores on your device, including your settings, preferences, and the local cache of recipient timezones. You can export or delete this data at any time using the in-extension Settings panel.
7. No warranty
THE EXTENSION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that:
- The extension will be free of bugs, errors, or interruptions.
- The extension will be compatible with all versions of Chrome, Gmail, or other software.
- The extension will produce results that meet your specific needs or expectations.
- Scheduled emails will be sent at exactly the intended time, since the actual sending is performed by Gmail’s native Schedule Send feature, which is outside our control.
Some jurisdictions do not allow exclusion of certain warranties. In those jurisdictions, the above exclusions apply only to the extent permitted by law.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE EXTENSION, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Because the extension is provided free of charge, our total cumulative liability for any claim arising from or relating to the extension or these terms is limited to the greater of one US dollar (US$1.00) or the amount you have paid us for the extension (which, for the Free version, is zero).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply only to the extent permitted by law, and our liability is limited to the maximum extent permitted in your jurisdiction.
This section does not exclude liability for any matter that cannot, by law, be excluded.
9. Indemnification
You agree to indemnify and hold harmless Fenil Dedhia from and against any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your misuse of the extension, your violation of these terms, your violation of any law, or your violation of the rights of any third party.
10. Termination
You may stop using the extension at any time by uninstalling it.
We may terminate or suspend availability of the extension, or your access to it, at any time, for any reason, with or without notice. In particular, we may stop offering or updating the Free version at any time, or transition it to a different model. If we do so, we will, where reasonably possible, give advance notice through the Chrome Web Store listing or the extension itself.
Sections 5 (“What you may not do”), 6 (“Your data,” to the extent of the Privacy Policy’s continued application), 7 (“No warranty”), 8 (“Limitation of liability”), 9 (“Indemnification”), 12 (“Governing law and disputes”), and 13 (“Miscellaneous”) survive termination.
11. Changes to these terms
We may change these terms from time to time. The current version of the terms will be available at https://fashionablylate.app/legal/terms (or its successor URL, with redirects from the prior URL maintained). The “Last updated” date at the top will be revised.
Material changes that affect your rights or obligations will be accompanied by a notice in the extension itself (e.g., a one-time prompt on next use) before the new terms take effect. If you do not agree to a material change, your remedy is to stop using the extension.
12. Governing law and disputes
These terms and any dispute arising from or relating to them or the extension are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws provisions.
The exclusive jurisdiction and venue for any dispute arising from or relating to these terms or the extension is the state and federal courts located in New Jersey, and both parties consent to the personal jurisdiction of those courts.
For users in the European Union, European Economic Area, or United Kingdom, this clause does not override mandatory local consumer-protection law that would apply regardless. If a mandatory provision of your local law gives you a more favorable governing-law or venue choice, that local law applies to the extent required.
13. Miscellaneous
- Entire agreement. These terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of the Free version of the extension. They supersede any prior agreement or understanding between us on this subject.
- Severability. If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision is replaced with one that most closely matches the intent of the invalid one to the extent permitted by law.
- No waiver. Our failure to enforce any provision of these terms is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer your rights under these terms without our prior written consent. We may assign our rights and obligations under these terms to a successor in connection with any merger, acquisition, or sale of substantially all of our assets, or to an entity we incorporate to operate Fashionably Late, on notice to you.
- No employment, partnership, or agency. Nothing in these terms creates an employment, partnership, joint-venture, or agency relationship between you and us.
